Indiana Updates Sales Tax Information Bulletin for Motor Vehicle Leases and Sales

Effective December 1, 2016, the Indiana Department of Revenue has updated two bulletins regarding the sales tax treatment of leasing and selling of motor vehicles and trailers.

Leasing of motor vehicles and trailers

Updated Sales Tax Information Bulletin #28L provides guidance regarding the tax treatment of negative equity in a vehicle, as well as additional examples related to transactions on leased vehicles. The bulletin explains how to calculate any allowable credit against Indiana sales and use tax for certain out-of-state sales and use taxes.

Selling of motor vehicles and trailers

Updated Sales Tax Information Bulletin #28S explains the changes as to how sales tax should be charged on certain vehicle sales when the vehicle will be transported and titled in another state or country. The bulletin also provides guidance regarding the tax treatment of negative equity in a vehicle.
