Sales Tax State Activity Update - August 2004
Certain Leases Exempt for the Entertainment Industry in Utah
Utah's Governor recently signed Senate Bill 190. It exempts from state and local sales and use taxes certain purchases, leases, or rentals of machinery and equipment by establishments relating to film, television, and video. The stipulation is that these purchases, leases, or rentals must be related to the production or postproduction of certain media for commercial distribution.
The machinery and equipment is exempt if the media is a motion picture production, a television program, a movie made for television, music video, commercial or documentary. However, machinery or equipment used in the production or postproduction of a live musical performance, a live news program, or a live sporting events is subject to tax.
