Sales Tax State Activity Update - September 2008
Wyoming Forms New Forms for Contractors
On August 22, 2008, the Wyoming Department of Revenue (DOR) published guidelines for the Construction Industry.
Included in their definition of a Contractor is "any person who owns or leases real property in this state for the purpose of developing that property... alters or makes improvements to the property or contracts for the alteration or improvement of the property."
Including persons or firms involved in these types of activities requires the registration of projects using non-resident contractors or subcontractors.
Registration of qualifying contracts must be reported on forms designed for that purpose and timely submitted to the DOR.
Two separate forms exist:
- Construction Project and General Contractor Registration Form ETS Form # 121 and
- Non- Resident Subcontractor Information Report ETS Form # 120.
Included in the registration requirements is the posting of a surety bond or cash deposit equal to 4% of the total contract value. Supplemental conditions exist for those projects that are short-term in nature. The guidelines reference projects that can be completed in a couple of days.
General and prime contractors as well as real property owners or lessors that rely on out of state contractors and subs should take the time to review these new guidelines.
